2010-2011 Winning Characteristics Scholarship Requirements

1. ELIGIBILITY: The Making It Count “Winning Characteristics” Scholarship (the “Scholarship”), is open to high school seniors who are enrolled in a public, private, charter, magnet, vocational, technical or parochial school, and who participated in a Making College & Career Count presentation (the “Presentation”) during the 2010-2011 school year (collectively the “Applicants”). Applicants must possess a cumulative G.P.A. of at least a "B" or higher at the time of application. Applicants must be U.S. citizens or permanent residents of the United States of America. Void in Maine, Puerto Rico, all U.S. territories and possessions and where prohibited by law. By the 2011 fall semester, Applicants must be enrolled at an accredited higher education institution or program (i.e. college, technical school, vocational school, formal career training program). This Scholarship is governed by US law and is subject to all applicable federal, state and local laws and regulations. Employees of Making It Count (“Sponsor”), its parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and members of the immediate family or household of each are not eligible. Immediate family members include parents, siblings or any person residing in the same household as employee.
2. SCHOLARSHIP PRIZE/ODDS: One first place winner will receive a $2,500 scholarship prize, and two runner-up winners will receive a $500 scholarship prize. Total ARV of all prizes: $3,500. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Scholarship prizes are not transferable, except at discretion of Sponsor. Scholarships awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. Any scholarship prize won will be awarded to the winner’s institution of higher education, for use on behalf of the winner. If winner chooses not to accept the scholarship prize, or if winner’s institution of higher education is non-responsive to Sponsor’s requests, an alternate winner will be chosen.
3. ENTRY: A complete entry consists of (1) Completion of the Making It Count Scholarship Application, a copy of which can be found at www.makingitcount.com/scholarship; (2) Essay Response to the question, “During your high school career, how have you demonstrated at least three ‘Winning Characteristics’ as discussed during the Presentation (Communication Skills, Organization Skills, Leadership, Logic, Effort, Group Skills and Entrepreneurship)?”; and (3) Mail the completed Making It Count Scholarship Application together with the Essay Response to Making It Count, Attn: Scholarship Coordinator, 10296 Springfield Pike, Suite 500, Cincinnati, OH 45215.
Essays must support your position with examples from inside the classroom, outside the classroom and on the job experiences. Essays must be at least 450 words long, and no longer than 600 words. Essays must contain the Applicant’s name, address, phone number, email address (if available), and school name in the upper left hand corner of each page. Materials other than the Making It Count Scholarship Application and Essay Response will not be accepted. Limit one entry per person.
Entries must have one author only – no co-written or multiple author entries permitted. Each entry must be the original work of the author and has not heretofore been published in whole or part in volume form. Partial entries will not be accepted. No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, incomplete, stolen, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur. All entries become the property of the Sponsor and will not be returned. Scholarship begins August 2, 2010 at 12:00 a.m. (EST) and ends on June 15, 2011 at 11:59 p.m. (EDT). Entries must be post-marked before June 15, 2011 and after the date of the Presentation.
4. WINNER SELECTION: Sponsor, via its judging designees, will review and select twenty (20) finalists from among all entries made. Sponsor will then select the first place national winner, and two runner-up winners from among the twenty (20) finalists. All judging will take place on or about July 15, 2011 through August 31, 2011 (the “Judging Period”). Entries will be judged by Sponsor and its designees according to the following equally weighted criteria: i) Content; ii) Organization; iii) Language; and iv) Overall Essay. All decisions made by Sponsor or its designees shall be final.
5. WINNER NOTIFICATION: The potential winner will be notified by Sponsor or Sponsor’s designee by email, telephone, overnight carrier or regular mail approximately fourteen (14) days after the close of the Judging Period. Return of any scholarship prize or scholarship prize notification as undeliverable, if Sponsor or Sponsor’s designee is unable to contact the potential winner after reasonable effort, or failure of potential winner to respond within five (5) days of first attempted notification, will result in forfeiture of prize and selection of an alternate winner. Sponsor reserves the right to disqualify any potential winner who fails to comply with these Scholarship Requirements, and Sponsor's/Sponsor’s designee’s requests, and award the scholarship prize to an alternate winner.
6. GENERAL: The potential winner will be required to sign and return to Sponsor or Sponsor’s designee a notarized Affidavit of Eligibility, a Liability Release, and, where legal, a Publicity Release, within ten (10) days of first attempted notification. If winner is a minor, the participant’s parent or legal guardian must execute these documents. If winner is under the age of 21, the participant’s parent or legal guardian must co-execute said documents. In the event of noncompliance, the potential winner may be disqualified and an alternate winner selected, at Sponsor's sole discretion. By entering, participants (a) agree to be bound by these Scholarship Requirements and the decisions of the Sponsor which are final and binding in all respects; (b) agree to release Sponsor, and its employees and agents from any and all liability, loss, damage or injury resulting from participation in this Scholarship or awarding, receipt, possession use and/or misuse of any scholarship prize awarded herein and acknowledge that Sponsor and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any scholarship prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; and (c) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes in connection with this Scholarship without additional compensation, unless prohibited by law.
7. INTELLECTUAL PROPERTY: All submissions made in connection with the Scholarship must be original works. By submitting an entry, you represent and agree that your submission will not infringe upon the intellectual property rights of any third party. All submissions and all information contained therein, including the copyright and all other intellectual property rights, become the property of Sponsor and will not be acknowledged or returned. By submitting a submission, you irrevocably assign to Sponsor all right, title, and interest in your submission in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade. The rights granted under this paragraph shall extend to all submissions and all other submitted materials related to the Scholarship, including those submitted by non-winners and winners. By submitting an entry, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all entrants in the Scholarship, including non-winners and winners.
8. DISPUTES: This Scholarship is governed by the laws of the United States and the State of New York, without respect to conflict of law doctrines. As a condition of participating in this Scholarship, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Scholarship, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
9. WINNERS LIST: For the name, city and state of residence of the winners, send a self-addressed stamped envelope by October 15, 2011 to Making It Count “Winning Characteristics” 2010 Scholarship Winner List Request, Making It Count, 10296 Springfield Pike, Suite 500, Cincinnati, OH 45215.
